2. They are misrepresenting and dividing citizens of Hawaii Nei- i prefer to support family on Kauai & Maui & Big Island than to go along with a big business scheme that will never benefit me or my future family. They have not even tried to convince us that this will be affordable, safe to the aumakua kohola, adequately prevent the spread of highly dangerous alien species around our delicate islands... they have done absolutely nothing to address any public concerns or make this a positive venture to unite Hawaii Nei. this is supposed to bring the islands closer, but it is too destructive to the outer islands. there is no aloha in forcing such a big presence upon a community that is not ready or willing to have such development.

3. The strykerferry is actually designed to be used by the military to transport large vehicles such as Strykers (see below) and increase the military's abuse and catastrophic devastation of our only and delicate ecosystem, communities and public safety & health. nuff said. this is truly dangerous. i am worried for my wellbeing, i will not be quiet about my own safety or my islands. if they default on the public loan then the military can buy these ferries at a much cheaper price.... they can also be 'attacked' and the insurance payment will go to who? this is not a public transportation system intended to be used sustainably by the majority low-middle class population of our state, this is a shocking scheme that some politicians are abusing their power to implement and that will only benefit maybe 5 humans, (none of whom are Hawaiian)

4. this sets a very bad example & precedent for doing business in Hawaii Nei, uninvited, illegal, unaccepted, disgraceful. This is our land & waters and such modern neo-occupation must be stopped before the New Mahele continues illegally.

some of us concerned citizens are gonna have a sleepover at ong king/chinatown this wednesday nite and all hele down to the strykerferry resistance thursday morning at the bootycrackodawn... the thursday KU'E shouldn't go later than 8:30 am so it shouldn't interrupt workday much.
just join us at the docks if you prefer to use your own transport.

join us after 9:30pm at OngKing, chinatown.... contact me for more details. we will arrange a safe group parking space in nuuanu wednesday night, then all shuttle down in one vehicle to the dock then capitol on thursday. all you need to bring is a sleeping mat/bag & snacks. there is a bathroom, but no shower, at ongking.

we are doing this because the strykerferry is being allowed to operate illegally without an Environmental Impact Statement (EIS), going in the face of the federal Environmental Protection Act, as well as Hawaii State Law- this is a true conspiracy that is dangerous to us on many levels:

1. if they operate without an EIS then they will not be held responsible for taking care of whatever damages they cause to Hawaii- the EIS serves not only to explain what problems might occur but also what the company is going to do to correct them, If they never put this in writing in an EIS then the burden of the destruction they cause will fall on the taxpayers in an already poor and struggling environmental crisis in our islands, we can't afford to shoulder more responsibilities for big business & military mistakes. Basically, the EIS is a commitment to fix the problems they cause. Why are they reluctant to make such a promise, how big are these problems, and can they even be fixed? If the EIS finds that the strykerferry will cause irreparable damage to Hawaii then why do we want it? They should have conducted an EIS before spending so much money... This incredibly misguided woman has the guts to be speaking about protecting pets in Hawaii, while she gives open season on endangered humpback whales, honu, and monk seals, by the “weapon of mass destruction” itself: Superferry. The Superferry survives at all costs in her book, Screw the sea life, the endangered birds, the bee colonies, the coqui infestations, even the human life for that matter of the neighbor islands.

Who was the moron bringing her to Kauai who thought she’d be the poster child for treating animals humanely? A fox speaking to a chicken convention would be just as humane.

Hawaii Superferry postpones Thursday relaunch

KAHULUI, Maui Hawaii Superferry is postponing the relaunch of its Maui-to-Honolulu service until the state can repair pier damage at Kahului Harbor caused by yesterday's high surf.

The company planned to resume service Thursday, and has yet to announce the postponement and a new start date, but Michael Formby of the Department of Transportation said the 350-foot high-speed catamaran would not be able to use the harbor for at least three days.

The time is needed to replace two bollards that were ripped from Pier 2 and to inspect the state-owned barge that will be used to load and unload vehicles from the ferry. The barge also must be realigned to accommodate ferry operations.

Formby said swells within the harbor yesterday were measured at 6 feet. He called the conditions the worst in recent memory.

Contrary to the popular notion put out by HSF, military, governor, a few legislators, amd corporate media, most of O'ahu people are against HSF operating without an EIS completed. Many would like to see HSF operating legally. The point of contention is basically the speed at which it will conduct its services within the maritime sanctuary which the HSF is objecting to. With their past history, we know that HSF will not abide by the laws and given the chance, they will break the rules. They need to be closely monitored. Having human observers looking out for whales will increase the risks as the speed is increased. There are other sea mammals to look out for which they will not be looking for; such as the endagered Hawaiian monk seals and the turtles that live in our waters. They will have to invent a non-intrusive method to spot all of these sealife that need protection from fast moving vessels. So far they haven't come up with a satisfactory means to accomplish this. If we as individuals behaved with the same wanton irresponsibility, endangering the sealife within the sanctuary, we would most certainly be arrested and charged for the crime. Why should the HSF have that immunity? Think about it!!! I, personally, would rather not have a speeding military superferry at all in our waters; but that's only me. If we can find a common ground for which it to operate, then that would be worth considering. My main objection is speed, policies, and military involvement. It's opening the acceptance of a police state and escalated militarism within our US belligerent occupied nation-state of Hawaii. ALL of our concerns must be addressed BEFORE it operates in our territory!

The last message we received from Kauai confirmed that a "Paddle-In to Resist" protest in the water will take place at Nawiliwili harbor at noon on Sunday 11/4.

Superferry informational briefings start Sunday on Kauai

The state Senate will hold informational briefings regarding the draft legislation to help the Hawaii Superferry on Kaua'i, Maui and the Big Island in advance of a possible special legislative session next week.
The first briefing will be 2 p.m. Sunday at King Kaumuali'i Elementary School cafeteria in Lihu'e.

The Maui briefing will be 3 p.m. Monday at the Baldwin High School auditorium in Wailuku.

The Big Island briefing is expected to be at 3 p.m. Tuesday at Kealakehe High School in Kailua, Kona.

Several senators, and a few House lawmakers, plan to attend to hear public comment on the proposed draft. A special session could start on Wednesday

"The Coast Guard quietly slipped a new permanent security zone rule into the Federal Register. The US Attorneys mentioned it in court on October 5 and for some reason I was unable to locate the rule in the Federal Register. I emailed the US Attorneys and the Coast Guard attorneys to request information about the rule that same day and never received a reply. I sent another email yesterday and finally got the information. Attached is the proposed permanent rule. The comment period is open until October 24. "We thought that maybe there was some other reason that these animals were getting hit," Berman said Monday. "Now we can rule out domoic acid."

The acid -- which is produced by a certain type of sea algae -- was not present in tissues extracted from the most recent dead blue whale, a 60-footer that was found in the Santa Barbara Channel and towed to a beach at Point Mugu for scientific examination on Sept. 22.

The freshest of the three whales, it was the only one to yield tissues that were not too decomposed for laboratory analysis.

In 1998, domoic acid was pinpointed as a poison that attacked the brains of dolphins and sea lions off the Central Coast, causing them to lose control of their movements, struggle for breath and sometimes wash ashore.

But the kind of algae that typically produces domoic acid has not recently been found in significant concentrations in the area, Berman said.

The two whales found in the Santa Barbara Channel had numerous broken bones, supporting the ship-collision theory. Collision is strongly suspected in the death of the third whale, which was found in Long Beach Harbor but towed out to sea before experts could get a detailed look at it.

End of Hawaii Superferry?? A letter from our lawyer =) Shaka~


Aloha,

For those who havnt heard, the Mau'i court ruled that Superferry could not operate in Mau'i waters until the State of Hawai'i completed its environmental assessment. At least one judge has now said the law is the law. That is refreshing given the rampant lawlessness and legal erroneousness we have been seeing of late.

The Mau'i ruling can be appealed and Superferry says that they are going to. I guess they like their lawyers because they will be paying for a fruitless appeal.

The Mau'i ruling also does not foreclose Superferry going to Kaua'i.

The tide has turned, however. I think that public perception of Superferry and the Unified Command forcing their way into Kaua'i after the Mau'i ruling would tend to correctly perceive who the law breakers are.

Today I filed an emergency appeal of the Federal Court's denial of a Temporary Restraining Order against the Coast Guard's security zone. Given that the Mau'i ruling is going to be appealed and does not apply to Kaua'i, I believe that the Ninth Circuit will still consider the case an emergency appeal. We shall see.

In the meantime, the stalwarts who pursued the litigation resulting in the Mau'i decision are part of the front line that stood its ground; the people jumping into the water on Kaua'i being the latest group to move up.

There was another front opened up today from within the sovereignty movement that will be sent out shortly.

Congratulations to everyone who managed to get a lasso on the Superferry beast and slow it down enough to show it the way out of Hawai'i.

The problem is that the Superferry's speed is incompatable with the whale sanctuary here...there are 5000 humpback whales in immediate Hawaiian water in the winter. There would be NO way the Superferry could avoid hitting them. The Superferry does NOT belong here at all.

I suggest they try to move to somewhere like Seattle.

Should HSF EVER try to enter our harbor again, we need every Kanaka with a fishing pole to line both sides of the harbor entrance from the little light house Kalapaki side as well as across lining the jetty,... wouldn't that be practicing your fishing rights AND not be required to have the required variance????

It's a no-go for the Hawaii Superferry.

That's the ruling this morning from Judge Joseph Cardoza, who has blocked the high-speed vessel from sailing to Maui until the Department of Transporation prepares a legally acceptable environmental assessment.

Cardoza also ruled the operating agreement between the Superferry and the State is null and void.
